Enforcement of Intellectual Property Rights

The European Commission has launched a consultation to evaluate the overall functioning of the enforcement system for intellectual property rights. The survey aims at gathering information on the efficiency of proceedings and accessibility of measures used in the context of civil enforcement of intellectual property rights.

In particular, the survey is seeking information from stakeholders that participated in proceedings concerning intellectual property rights, namely claimants and defendants as well as from others involved in such proceedings. Individuals, companies and organisations are all welcome to respond to the consultation.

The Commission will then conduct an assessment of the functionality of Member States' enforcement systems with the aim of improving the situation of those active in the innovative sectors of the European economy.

The UK has recently introduced a new small claims track in the Patents County Court in a response to the creative sector's calls for a cost effective forum for intellectual property claims. The consultation offers the chance for those with experience of the small claims track to voice their opinions regarding its effectiveness.
